Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.

To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Company nor any of the company's provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service.

You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.

Referral Program Disclaimer

Disclaimer:

By participating in SMATACT ACCOUNTING AND TAX SERVICES LTD 's Referral Program (the "Program"), you agree to the following terms and conditions: as well as any additional terms communicated to you in connection with the Program. If you do not agree with any part of this Disclaimer, you must refrain from participating in the Program.

Eligibility:

The Program is open to individuals who have an active account with SMATACT ACCOUNTING AND TAX SERVICES LTD. and of the Legal Age.

Referees must be new customers who have not previously registered with SMATACT ACCOUNTING AND TAX SERVICES LTD.

Employees of the Company, its affiliates, subsidiaries, advertising or promotional agencies, and immediate family members or persons living in the same household are not eligible to participate.

Rewards:

Referrers will receive $20 CAD for each successful referral after paying the required fees that include but are not limited to the Admin and Processing Fee.

Referees will receive a 10% discount after they have paid the required Tax Filing Fees".

Rewards and discounts are non-transferable and cannot be exchanged for other forms of compensation unless stated otherwise.

Conditions:

A referral is considered successful only when the referred customer signs up using the unique referral code or link and meets all program requirements

Discounts may have usage limits, expiration dates, or minimum purchase requirements, as specified in the promotional details.

Limits:

Each participant may refer upto "100 friends/family per month".

Total rewards per referrer are capped at amount, e.g., "$2000 per calendar year", unless otherwise stated.

Program Changes:

SMATACT ACCOUNTING AND TAX SERVICES LTD. reserves the right to modify, suspend, or terminate the Program at any time without prior notice.

Any changes to the Program will be effective immediately upon posting updated terms on our website.

If the Program is terminated, any Rewards earned but not yet redeemed may be forfeited at the Company’s discretion.

Fraudulent Activity:

Referrals generated through fraudulent or unethical means, including but not limited to creating multiple accounts, spamming, or misrepresentation, will result in disqualification from the Program and forfeiture of rewards.

Taxes:

Participants are responsible for any tax implications related to the receipt of rewards under this Program.

The Company may be required to report Rewards to tax authorities in accordance with applicable laws and regulations. Participants may be required to provide additional information or documentation.

Legal Compliance:

The Program is void where prohibited by law.

Participants must comply with all applicable laws and regulations in their jurisdiction.

Limitation of Liability:

The Company is not responsible for any errors, omissions, interruptions, or delays in the Program due to technical issues, network failures, or other circumstances beyond our control.

The Company will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Program, even if advised of the possibility of such damages.

The Company’s total liability for any claims arising under the Program will not exceed the total amount of Rewards earned by the Participant.

Governing Law and Dispute Resolution:

The Program and this Disclaimer will be governed by and construed in accordance with the laws of British Columbia Canada.

Any disputes arising under or related to the Program will be resolved exclusively through arbitration, mediation, or other alternative dispute resolution mechanisms as determined by the Company, unless prohibited by law.

11. Void Where Prohibited

The Program is void where prohibited by law. Participants are responsible for ensuring compliance with all applicable laws and regulations in their jurisdiction.

The Company will not be held liable for any Participants’ failure to comply with local laws or regulations.

12. Acceptance of Terms

By participating in the Program, Participants agree to be bound by this Disclaimer and any additional terms communicated by the Company in connection with the Program.

Participants who do not agree with any part of this Disclaimer must refrain from participating in the Program.

Disclaimer for Tax Filing Services

General Information This disclaimer applies to all tax filing services provided by SMATACT ACCOUNTING AND TAX SERVICES LTD. (referred to as "we," "our," or "us"). By engaging our services, you acknowledge that you have read, understood, and agreed to the terms outlined in this disclaimer. Our tax filing services are designed to assist individuals and businesses in meeting their tax compliance obligations. However, these services are not intended to substitute for professional financial, tax, or legal advice tailored to your specific circumstances.

Accuracy of Information Our ability to provide accurate and timely tax filing services relies on the completeness and accuracy of the information you provide. Audit support or assistance unless explicitly agreed upon in a separate engagement.

Ongoing tax planning or financial advisory services unless stated in the service agreement.

If additional services are required, such as audit support or amended returns, these will incur additional fees and must be agreed upon in writing.

Compliance with Deadlines We make every effort to meet filing deadlines based on the information you provide. However, we are not liable for penalties, interest, or other consequences resulting from delays caused by:

Late submission of required documents or information by you.

Errors or delays by tax authorities.

Unforeseen circumstances beyond our control, such as technical failures or natural disasters.

To ensure timely filing, we require that you provide all necessary documents and information well in advance of the applicable deadlines.

Confidentiality and Data Security We are committed to protecting your personal and financial information. All data provided to us is handled in accordance with applicable privacy laws and our internal data protection policies. However, while we implement robust security measures, we cannot guarantee absolute protection against unauthorized access, data breaches, or cyberattacks. By using our services, you acknowledge and accept this inherent risk.

Limitations of Liability To the fullest extent permitted by law, we disclaim any liability for:

Errors or omissions in the preparation of tax returns caused by inaccurate or incomplete information provided by you.

Decisions made by tax authorities, including audits, assessments, or rejections of claims.

Penalties, interest, or other consequences resulting from late filings, errors, or omissions.

It is your responsibility to review your tax return and understand its contents before submission.

Client Responsibilities By engaging our services, you agree to:

Provide complete and accurate financial and personal information necessary for tax preparation.

Review and approve the prepared tax return before submission.

Retain copies of your tax returns and supporting documentation for the required period, as specified by tax authorities.

Inform us promptly of any notices, audits, or inquiries received from tax authorities.

Termination of Services We reserve the right to terminate our services at any time if:

We discover material misrepresentations or omissions in the information provided by you.

You engage in unlawful or unethical conduct that compromises the integrity of our services.

In the event of termination, you remain responsible for any fees incurred up to the termination date.

Indemnification You agree to indemnify and hold us harmless from any claims, liabilities, damages, or expenses arising from:

Your use of our services in violation of applicable laws or regulations.

Actions taken by tax authorities based on the information provided in your tax return.
